A Memorial of the within deed was entered in the register office in the city of Dublin the third day of July 1802 at one o'clock in the afternoon in book 545 page 432 number 361307 and the execution of the said deed and Memorial was duly proved pursuant to an Act of Parliament in that Case. This indenture made 29th day of January in the year of our Lord 1800 between Catherine DONALDSON[2] of Derrynaught[3] in the County of Armagh widow of the first part and Alexander DONALDSON[4] in Philipstown[5] in the County of Louth gentleman of the other part, WITNESSETH, that the said Catherine DONALDSON for and in consideration of the yearly rent and covenants here in after reading served doth demise, granted, set, and to farm let; and by these Presents demise, Grant, set, and to farm let, unto the said Alexander DONALDSON ALL that part of the lands of Philipstown now in the occupation of the said Alexander DONALDSON and his undertenants containing by estimation 73 acres three roods and 79 perches Irish plantation measure for the same more or less with their proportional part of the bog of Philipstown meared and bounded, on the Southeast by the lands in the occupation of the said Alexander DONALDSON, on the southwest by Thomas MORGAN[6] and Peter MORGAN[7] Hugh McDONNELL[8] and Owen McINTEGART[9] on the North West by the said Alexander DONALDSON Patrick HUGHES[10] and Owen McINTEGART And on the northeast by the river of said Philipstown, Which said lands and premises are situate lying and being in the Manor of Roche Barony of Dundalk and County of Louth aforesaid... to have and to hold, the said demised premises, with the rights, members and appurtenances thereunto belonging or in any wise appertaining, unto the said Alexander DONALDSON his heirs executors administrators and assigns from the first day of November last for and during the natural life and lives of James COULTER[11] of Annaghvacky[12] in the County of Louth Yeoman and of the said Alexander DONALDSON the lessee and John DONALDSON[13] son of Joseph DONALDSON[14] of Cloghogg[15] in the County of Armagh Gent: and the survivor and survivors of them and for and during the natural life and lives of such other person and persons as by virtue of a covenant for perpetual renewal shall be added and invested in the Original Lease granted by Robert SIBTHORPE[16] then of Duneany[17] in the County of Louth Esquire but since deceased to the said Catherine DONALDSON... using and paying therefore and thereout, yearly, and every year, during the said demise unto the said Catherine DONALDSON her heirs executors administrators and assigns, the yearly rent of 42 pounds and one shilling sterling to be paid by even half yearly payments on every first day of May and first day of November in every year during the said demise over and above all taxes charges and impositions whatsoever; the first payment thereof to be made on the first day of May next ensuing the date of these presents. AND if the same reserved yearly rent or any part thereof, shall happen to be behind her unpaid by the space of 21 days next after the days herein before mentioned for the payment thereof, then in so often as it shall so happen, it shall and may be lawful to and for the said Catherine DONALDSON her heirs executors administrators and assigns, into the said demise premises or any part thereof, to enter into destrain, and the distress and distresses then and therefore found, to lead, drive take away and dispose of according to law: AND if no sufficient distress or distresses, shall or may be found on the said demised premises, to satisfy the said rent, and all arrears thereof, and it shall and may be lawful to and for the said Catherine DONALDSON her heirs executors administrators or assigns, into the said demised premises, or any part thereof in the name of the whole, to re-enter and the same to have again, repossess, and enjoy as in his or their former Estate, anything in these Presents contained to the contrary in any wise notwithstanding. AND the said Alexander DONALDSON doth for himself his heirs executors administrators and assigns, covenant, promise and agreed, to s[?d] with the said Catherine DONALDSON her heirs executors administrators and assigns by these Presents that he the said Alexander DONALDSON his heirs executors administrators and assigns shall and will from Time to Time, and at all Times hereafter during the term hereby demise, well and truly satisfy, contract, and pay to the said Catherine DONALDSON her heirs executors administrators and assigns the said yearly rent, on the said days and times herein before mentioned for the payment thereof, clear above all taxes as aforesaid. AND that the said Alexander DONALDSON his heirs executors administrators and assigns, shall and will, during this demise, preserve, uphold, support, maintain, and keep the said demise premises, and all improvements made and to be made thereon, in good and sufficient order, repair, and condition; and at the end or other sooner determination of this demise, shall and will so lease and yield up the same unto the said Catherine DONALDSON her heirs executors administrators and assigns and also shall and will grind all malt corn and grain that shall be expended on the premises or ground for sale at the mill of Philipstown and pay the usual sale or mulcture for grinding of the same or in default thereof shall pay unto the said Catherine DONALDSON her heirs or assigns the sum of five shillings per barrel for every barrel of such malt corn or grain that shall be ground at any other mill or mills contrary to the true intent and meaning of these presents AND the said Catherine DONALDSON doth hereby for herself her heirs executors administrators and Assigns, covenant, promise, and agree, to and with the said Alexander DONALDSON his heirs executors and administrators and Assigns, paying the said reserved yearly rent and performing the covenants herein before mentioned, shall and may peaceably and quietly have, hold, and enjoy the said premises, with the appurtenances, during the term hereby demised, without any let, hindrance, interruption, or disturbance of the said Catherine DONALDSON her heirs executors administrators or assigns, or any person or persons claiming or deriving from or under her or any of them And the said Catherine DONALDSON for herself her heirs and assigns further covenant and promise and agree to and with the said Alexander DONALDSON his heirs executors administrators and assigns by these Presents that from time to time and at all times forever hereafter for as often as any of the lives for which the said premises and by these presents granted and demised or any other life or lives hereafter to be added shall happen to fall she the said Catherine DONALDSON her [the page was folded and illegible her] will upon the request but at the proper [?] in charges of him the said Alexander DONALDSON and his heirs or assigns and upon his paying all rent and arrears of rent then due by virtue of these presents to or any future renewal thereof and upon the performance of all the covenants and agreements to herein contained upon the part of him the said Alexander DONALDSON his heirs executors administrators and assigns to be performed and upon payment of a peppercorn if demanded by way of a fine upon the fall of every life herein contained or which shall hereafter be added by virtue of these Presents for a new demise on renewal of the said demised premises unto himself the said Alexander DONALDSON his heirs executors administrators and assigns for such other life or lives as shall be [?] in the said original lease in the place and stead of such life for lives as shall appear to fail at and under the yearly rent and covenant agreement herein contained to the asked intent that he the said Alexander DONALDSON his heirs executors administrators and assigns if it be not his own fault or neglect hand the term of these lives in being the said demised premises and under the yearly rent covenant and agreements herein contained in witness thereof the parties aforesaid have hereunto put their hands and seals the day and year first before written and delivered in this [?]

[2] Catherine DONALDSON nèe BAILIE (1729-1811. She was the second wife of Andrew DONALDSON (1712-1773) SOURCE: Irish Edition of Alexander ban DONALDSON p252. A decade after she was widowed, she obtained a lease for life of part of the lands of Phillipstown then held by her under a lease of 5 January 1737 except for the lands then occupied by the Rector of the Parish.

[4] Alexander DONALDSON (1771-1843) SOURCE: Irish Edition of Alexander ban DONALDSON p252. He purchased his mother's lease of Phillipstown on October 18, 1811. He died unmarried. SOURCE: Irish Edition of Alexander ban Donaldson, p 254: A well to do man who started building Phillipstown House in Co. Louth in 1826. When his nephew Alexander Charleton died in 1828, he was grief-stricken enough to stop work on it. "After Alexander Charleton's death his brother William Charleton came to live with him and died there on 25Sept1875 age 77, unmarried. This William in his will dated 24 April 1872 left all his real estate to his nephew Thomas William BELL who completed building the house."

The will of Alexander Donaldson (dated 25 May 1843) left his relatives Alexander McELROY part of his land - also William CHARLETON. "In 1834 he owned 30 good acres in arable state, 10 acres arable, 10 acres pasture and 2 marsh."

He also owned land in Annaletten, Co. Monaghan and in Gibstown, Co. Louth; he served on the Grand Jury of Louth and was also High Sherriff.

[12] Annaghvacky is a townland of 369 acres in the Parish of Creggan, Co. Louth. In the 1854 Griffiths valuation, it seems that most of the townland is owned and leased to people who are related (DICKIE, BAILIE, BRADFORD, OLIVER). The total value was £283 1 0.

[13] John DONALDSON (?-aft 1838) It would seem that he never married, and was the author of A historical and Statistical Account of the Barony of the Upper Fews. March 1838. A Facsimile reprint was edited by Micahel MacSedin and published by The Creggan Local History Society, Crossmaglen, 1993.

[14] Joseph DONALDSON (1727-1805) of Cloghogg. He was the son of Alexander DONALDSON & Alice McILVEEN. He married Anne HENRY and they had ten children.

[15] Cloghogg, a townland of 929 acres in the Parish of Creggan, Co. Armagh NOTE: There are also townlands with the same name in the Parishes of Killevy & Ballymore.

[18] William CHARLTON akak CHARLETON married Dorothea DONALDSON, daughter of Andrew DONALDSON & Catherine BAILIE. They had five known children. He was "said to be descended from a Shropshire family, probably Cromwellian."SOURCE: Irish Edition of Alexander ban Donaldson p 252 Family details are in the Creggan Cemetary (the William CHARLETON here is his son): Here lies the body of Andrew Donaldson of Philipstown Co. Louth died 29 Oct 1773 aged 61 years; Catherine Donaldson alias Bailie his wife died 12 April 1811 aged 82 years and their only son Alex Donaldson died 7 Novr 1843 aged 72 years; also their daughter Alice Donaldson died 5 Feby 1788 aged 19 years and Dorothea Charleton alias Donaldson died 26 Jan 1821 aged 52 years and her sons Alex Charlelon died 28 Septr 1828 aged 25 years and William Charleton died 25 Septr 1875 aged 77 years.
