NOTE: I must order this deed.

Deed of Settlement between Andrew OLIVER[1] of Brootally, Co. Armagh of the first part. William OLIVER[2] of Brootally, Co. Armagh, Uncle of the said Andrew OLIVER of the second part the said William OLIVER and Andrew Coulter BRADFORD[3] of Cavananore[4] in the Co of Louth former trustees named in a certain deed of assignment bearing date 2 Sept 1841[5] of the third part. Anne HANNA[6] of Taraskane, Co. Armagh spinster, 3rd daughter of William HANNA[7] late of Taraskane[8] aforesaid farmer, deceased of the fourth part and John HANNA[9] of Taraskane aforesaid a trustee names and appointed to and for the several uses  .. of the 5th par. Whereby after reciting ... that a marriage was there intended to be shortly had and solemnized between the said Andrew OLIVER, therefore William OLIVER and Andrew Coulter BRADFORD granted to John HANNA Brootally lands .. 25 acres 3 roods 10 perches as described in the lease 1 Nov 1828[10] between Maxwell CLOSE[11] of Elm Park[12], Co. Armagh & James OLIVER[13] of Brootelly in parish of Derrynoose ... lands of Killylea[14] 18 acres 2 perches, parish of Tynan as described in the lease of 15 Aug 1830[15] made between Sir James Maxwell STRONG[16] of Tynan House, Co. Armagh Bart & Henry Samuel CLOSE[17] & John Tew AMSTRONG[18], both of the City of Dublin esq., executors of John MAXWELL[19], late of Fellows Hall Co. Armagh of the one part and William OLIVER of the other part. Witnesses: William OLIVER[20] the younger of Brootelly, Co. Armagh, farmer & Saul HANNA[21] of Terreskane, City of Armagh, Farmer. Witness David SCARLETT[22] of Tynan, Co. Armagh.

 



[1] Andrew OLIVER of Brootally, Co. Armagh. It is quite likely that this is Andrew Bradford OLIVER (1818-1877), son of Benjamin OLIVER and Elizabeth BRADFORD and that this deed deals with a marriage that involved a first wife (he subsequently married Anne NORRIS some time before 1853).

[2] William OLIVER of Brootally, Co. Armagh. If he is an uncle of Andrew Bradford OLIVER, then he would be of Ennislare and likely the husband of Elizabeth BALLANTYNE.  I do not have a death date for him, but there was a probate for William OLIVER of Brootally for 1854, a farmer.

[3] Andrew Coulter BRADFORD (1788-1847) of Cavananore was the brother of Elizabeth BRADFORD and brother-in-law of Benjamin OLIVER (1765-1831) of Ennislare & Killynure, Co. Armagh. He died unmarried.

[4] Cavananore, Co. Louth was the home of Mary Jane OLIVER (1821-1875), daughter of Benjamin OLIVER and Elizabeth BRADFORD.

[5] NOTE: What is this deed of assignment bearing date 2 Sept 1841?

[6] Anne HANNA married Andrew OLIVER at Eglish Parish on March 22, 1843. SOURCE: LDS. This date agrees with the date given in the Marriage Bonds Index of Armagh. It is possible she was b. DEC 1819   Eglish Parish, Armagh, Ireland. (SOURCE: LDS Batch C700811) and that her mother’s name was Martha and that she had siblings named Maria, William, Alicia, and Elizabeth – all christened at Eglish Parish.

[8] Taraskane AKA Terraskane, Parish of Eglish, Co. Armagh. In 1753 Armagh Freeholders lists it was known as Terryskean. PRONI D/1928/F/1B

[9] John HANNA possibly the brother of Anne HANNA.

[12] Elmpark AKA, Mullaghatinny, Parish of Eglish. It is on the border of the townland of Killylea and is just a few townlands south west of Mullintur.

[13] James OLIVER of Brootelly. Following the earlier reasoning, he could be another uncle and he probably died in 1853. (Will probate for James OLIVER of Brootally). He was a farmer.

[20] William OLIVER jun. b. 27 Jul 1828, son of William OLIVER and Elizabeth BALLANTYNE (if the earlier assumptions about his father are correct)

[22] David SCARLETT of Tynan, Co. Armagh. NOTE: in 1819, a David SCARLETT was Master of the Primate’s Free School and lived at Rokeby Green, City of Armagh.
