Will of John Oliver Ballycrummy

 

This is the last Will and Testament of me John Oliver[1] of Ballycrummy[2] in the County of Armagh made this sixth day of December in the year of our Lord one thousand nine hundred and nine. I hereby revoke all wills by me at any time heretofore made, appoint my two sons Simon Francis Oliver[3] and James Oliver[4] to be my Executors and I direct that all my just debts and funeral and Testamentary Expenses shall be paid as soon as possible after my decease. I hereby give and bequeath unto my son James Oliver my farm of land in Ballycrummy, and will and bequeath unto my son Simon Francis my farm of land in Drumcoot[5] and I also allow him his share of my house in Ballycrummy if he works agreeable with my son James Oliver to work together as now for at least five years till the stock and chattels to be equally divided between my two sons Simon Francis and James Oliver of Ballycrummy. To my son Joseph Oliver[6] ten pounds. To my son Patrick Oliver[7] ten pounds. To James Lynch[8] a boy now living with me ten pounds provided he stays here for five years. All monies to be paid not later than five years. In case my son Simon Francis succeeds my son James my farm of land in Ballycrummy to go to my son Simon Francis. In case my son Simon Francis dies without heir my farm of land in Drumcoot to go to my son James Oliver and if my two sons Simon Francis and James dies without heir my two farms of (over) land to go to my son Patrick Oliver if alive if not my son John Oliver to succeed. The word succeed on Fourth line of first page should be survive instead of succeed as written.

[1] John OLIVER b abt 1841. Died December 17, 1909. He was probably born at Tullymore. His wife, Margaret ROCK was alive in 1901, but may have died before this will. More research is needed. It is possible that a son Bernard died as a child, since there is no further reference to him. Another son, John is not mentioned. He was married with children. There is also no mention of a daughter Anne, who died as a spinster. There is also no mention of the youngest son, Thomas.

[2] Ballycrummy, Parish Armagh, Co. Armagh. It is on the southern border of Drumcoote

[3] Simon Francis OLIVER born October 8, 1876 at Ballycrummy and probably died there on June 10th, 1952. He was the  7th child, and 6th son.

[4] James OLIVER, eldest son b. 1864.

[5] Drumcoot aka Drumcoote, Parish Armagh, Co. Armagh. it is on the northern border of Ballycrummy.

[6] Joseph OLIVER born July 30th, 1874. . He was the 6th child and 5th  son . He was already married with 3 children at the time of this will. It is possible that he already had his share of the estate.

[7] Patrick OLIVER born March 4, 1870 at Ballycrummy. He was already married with a son Patrick born in March of the year of this will. It is possible that he already had his share of the estate.

[9] George LOUGHRAN (1865-). In the 1901 Census he is residing in Ballycrummy with his wife and 5 sons.

[10] Michael GARVEY (1871-) In the 1901 Census he is resient in Ballyrath with his wife, 3 daughters & 2 sons.

[11] Thomas W. COWAN (1841-) was a clerk in the Probate Office. In the 1901 Census, he lived at 25 Abbey St. with his wife and son (Harold G.S. COWAN was also a clerk in the Probate Office).
