1685 Francis JACKSON of Dublin PRONI D2538/A/15. -Feoffment from Francis Jackson Senior, Gent., Dublin, 1st part; Francis Jackson Junior, Gent., Dublin, 2nd part; to John Read, Gentleman, of Dublin, 3rd part; of Moghan, Co. Tyrone. Consideration £30.
NOTE: There are three Francis JACKSONs mentioned in this lease: 1. Francis JACKSON, deceased, father of the Francis JACKSON, the elder. 2. Francis JACKSON, the elder. His signature is quite shaky, so I suspect that he was infirm, possibly quite elderly in 1685. He was not described as a father of Francis JACKSON the younger. 3. Francis JACKSON, the younger. He was likely related – but was likely not a son of Francis JACKSON the elder.
This Indenture made the fifteenth Day of Aprill in the first yeare of the Reigne of our Soveraigne Lord James the Second by the grace of God of England Scotland France and Ireland King Defender of the Faith etc. And in the yeare of our Lord One thousand Six hundred Eighty five Betweene Francis JACKSON of the parish of the Citie of Dublin and Francis JACKSON the younger of the same Gentleman son and heir apparent of the Said Francis JACKSON the elder of the one part and John READ of the said city of Dublin gentlemen of the other part whereas the said Francis JACKSON the elder and Francis JACKSON the Younger by this deed indented bearing date the 14th day of this inst August for and in consideration of 5 shillings in hand and as demised bargained & sold unto the said John READ all that the town and lands of Moghan [Moghan, Parish Donaghmore, Barony Dungannon Middle] situate lying and being in the Barony of Dungannon in the county of Tyrone in as large ample and beneficial a manner as the same or any part and parcel thereof is now or at any time heretofore hath been held possessed and enjoyed either by Francis JACKSON late of Dungannon deceased in his life and time father of the aforesaid Francis JACKSON the elder or by him the said Francis JACKSON the elder since the decease of the said father together with all edifices houses messages tenements gardens orchards commodities easements profits and hereditaments in any ways thereto belonging with the rents issues profits customs and duties reserved or payable out of all and singular the aforesaid premises and also all than the aforesaid Francis JACKSON the elder and Francis JACKSON the younger whose estate right title and interest something and demand whatsoever something to all and singular the possessions in and to every part and parcel thereof. To have and to hold the aforesaid town and lands of Moghan together with all and singular the premises aforesaid thereby demised and bargained and sold or intended to be thereby demised and bargained and sold with their and every of their rights members and Appurtenances unto the said John READ his executors and his assigns from the day next before the date thereof for and during the term and space of the whole years yielding and paying thereof and there out for the said years the rent of 1 peppercorn at the feast of Saint Michael the Archangel if demanded. To the intent that by virtue of these presents and of the [??] for transferring uses into possession the said John READ may be in the actual possession of the premises and may so thereby enable and to accept of a Grant and Release of the Reversion and Inheritance of the before mentioned & premises to him and his heirs forever recited whose possession of indenture may more at large appear relation thereunto being had and now this indenture witnesseth that they said Francis JACKSON the elder and Francis JACKSON the younger for divers good and valuable causes and considerations them thereunto moving but more especially for and in consideration of the sum of thirty pounds sterling do then in hand page before the ensealing and perfection of this presence by the said John READ the receipt whereof and of every part thereof then they said Francis JACKSON the elder and Francis JACKSON the younger jointly and severally do there by acknowledging and do in those presents for themselves and for each of them severally their and every of their several executors administrators and assigns forever exonerate acquit and discharge the said John READ his executors administrators and assigns of an from the same and of and from every part thereof have given granted bargained and Sold Enfeoffed[1] Promised and released and forever quit claim and confirmed and the said Francis JACKSON the elder and Francis JACKSON the younger for themselves their and every one of their several heirs do by these presents jointly and severally give grant bargain and Enfeoffed remise, Release and forever quit claim and confirmed under the said John READ the town and lands of Moghan aforesaid situate and lying and being in the town the Barony of Dungannon county of Tyrone together with all edifices houses messages tenements gardens orchards commodities easements prophets and their elements in any way thereunto appertaining or belonging now in his actual possession by virtue of said indenture of bargain and sale there in before renewed and mentioned and also all the estates right title claim and demand what so ever of them they said Francis JACKSON the elder and Francis JACKSON the younger and all the estate right title claim and demand of each of them severally there and every of their heirs and assigns of and unto the said town and lands of Moghan and in and to every part and parcel thereof and the reversions and re versions remained remainder and remain doors rents issues and profits of all in singular the premises and of every part and parcel thereof in as large and ample and confirm and beneficial manner as the same or any part or parcel thereof is now or at any time heretofore has been held possessed and enjoyed either by Francis JACKSON late of Dungannon deceased in his life and time father of the aforesaid Francis JACKSON the elder or by the said Francis JACKSON the older since the decease of his said father to have and to hold the before mentioned town and lands of Moghan together with all the singular the premises with their and every of their right members and appurtenances in anyway thereunto appertaining or belonging unto the said John READ his heirs and assigns forever to the only proper use and to have him the said John READ his heirs and assigns for ever And the said Francis JACKSON the elder Francis JACKSON the younger for themselves and for each of them jointly and severally and every of their several heirs executors something in assigns do covenant promise grant and agree to and with the said John READ's heirs executors Administrators and assigns and to and with every one of them that said town and lands of Moghan all and singular other the premises with the appurtenances below in and by these presents given granted and bargained and sold perfected Enfeoffed released and confirmed and every part and parcel thereof at the time of the ensealing and perfection of the perfect and so from time to time remain and confirm under the said John READ his heirs and assigns clearly acquitted and discharged or otherwise sufficiently saved and kept harmless and from all such all manner of former and other bargain sales gifts grants lease [?pitures] Dowers uses wills rents charges [Rentsects?] Recognizances Judgments executions seizures intrusions extents and of and from all other charges titles troubles encumbrances and demands whatsoever has made acknowledges consents send suffered and done by the said Francis JACKSON the elder and Francis JACKSON the younger or by any one of them or by the person or persons what so ever claiming or desiring any said ties interest or demands and something under any one of them they said Francis JACKSON the elder and Francis JACKSON the younger the [there is a hole in the document here and some text is missing] Of their several heirs and assigns and do covenant promise grant and agree to and with the said John READ his Heirs and assigns bye these presents that the said Francis JACKSON the elder and Francis JACKSON the younger jointly and severally there and every of their several heirs and assigns shall and will from him from time to time and at all times hereinafter upon the reasonable request and that the costs and charges in the law of the said John READ his heirs and assigns make and execute or cause or proceed to be made and executed all and every such further and other act and acts conveyances and assurances in the law whatsoever their further and better conveying assuring and something they said towns and lands of Moghan together with the appurtenances thereon belonging unto the said John READ his heirs and assigns forever be it by fine or fines recovery or recoveries with single or double [Vouchers?] Enfeoffed release or otherwise show forever as by the said John READ his heirs or assigns or his or their Council learned in the law shall be reasonably devised and advised or recognized with said [fine?] or [funds?] recovery or recoveries shall be and Ensurer and hearby is declared to be and ensured to the only use of the said John READ his heirs and assigns forever according to the said intent and meaning of the said presents and to no other use and intent or purpose whatsoever. And the said Francis JACKSON the older and Francis JACKSON the younger for themselves jointly and severally and for their and every one of the several heirs the before mentioned and town and lands of Moghan with all and singular the appurtenances thereto belonging to belonging unto the aforesaid John READ his heirs and assigns against themselves and against each of them their and every of their several heirs and assigns and against all other person or persons whatsoever will warrant and forever defend by these presents in witness whereof the parties to these presents above mentioned have interchangeably set their hands and seals this first day and here first above written.
Know all [?] by these presents that was the within named Francis JACKSON the elder and Francis JACKSON younger have at the time of the ensealing and delivery and perfection of the within written deed received the sum of 30 pounds in sterling from the hands of the within mentioned John READ the same being the purchase money in the within deed expressed of which this some end of every part thereof we the said Francis JACKSON the elder and Francis JACKSON the younger for ourselves and for each of us our and every of our heirs executors and assigns do hereby confess and acknowledge ourselves jointly and severally fully satisfied and well and truly content and paid and they said John READ his heirs executors deponents assigns to be thereof and there from henceforth forever of clearly acquitted and discharged as witness our hands and seals the 5th day of August anno domini 1685 signed sealed and delivered in the presence of us
