Memorial of an indented deed of
mortgage bearing date the sixth day of May in the year one thousand eight
hundred and seven and eight between Joseph Oliver of Tullamorein the county of Armagh Gentlemen of the one part
and Joseph Leeof the city of Armagh Innkeeper of the other part.
It recited a lease dated the twenty fourth day of April in said year one
thousand eight hundred and seven whereby John Pringleof Caledon in the County of Tyrone Esquire Demised
unto said Joseph Oliver all that and those that part of the Townland of
Kennedyssituate lying and being in the County of Armagh
aforesaid then in the tenure and occupation of the said Joseph Oliver
containing by estimation ninety four acres and thirty perches English
measure be the same more or less all of all which said demised Lands and
Premises are Meared and Bounded as follows that is to say, on the East by
the lands of Ballynahone, on the West by Kennedys on the North by the Lands
of Ballyrath and on the South by the Road leading from Armagh to Monahan
with all and singular the rights members and appurtenances thereto belonging
in any wise appertaining as particularly described in the map thereoff to
said Lease annexed To Hold unto said Joseph Oliver his Exors Admons and
Assigns from the first day of May then last past for the term of Twenty
Years Subject to the Yearly Rent of one hundred and seven pounds two
shillings and nine pence payable half yearly. In which Lease is contained a
Toties QuotiesClause or Covenant for the Renewal thereof from
twenty years to twenty years successively as long as the said John Pringle
his Exors Admons and Assigns shall hold and enjoy under the Vicars Choral
and Organist of St. Patrick's Cathedral of Armaghthe several denominations of land and appurtenances
of which said demised premises are part and parcel upon the terms and
conditions in said Lease expressed. And by the Deed of which this is
a Memorial said Joseph Oliver Granted his Interest in said demised Premises
in Mortgage to said Joseph Lee Subject to Redemption on payment of six
hundred pounds Stg with legal Interest for the same on the first day of

recited a marriage then intended between said Patrick McCleland and Margt Oliver and that said Patrick McCleland was entitled to a certain part or
proportion of the townland of Nappagh in the Parish of Tullycorbet and
County of Monaghan theretofore demised by the Revd. Dr. Henry
Leslieof
Tandragee in the County of Armagh deceased onto one John Leefor
the lives of Alexander McClellandof
Laraghand
John Lees and James Leeswhichever
should last longest at the yearly Rent of Eleven Pounds two shillings and
one penny, the interest of said John Lee having become legally vested in
said Patk McCleland. It also recited that the Rev. John Creeryof
Tandragee aforesaid by lease dated the second day of February one thousand
eight hundred and four Demised to said John McCleland all that part of
Wilson'stenement
commonly called the Ballalleyon
the west side of the street of Ballybay then in his possession and
containing as laid off by Patrick McCabeForty-two
feet and eight inches in front, and one hundred and ten feet in the rere,
bounded on the South by the remainder of said Tenement let to Dr. McMurrayon
the west by the Town Meadows, on the north by Morrow’sTenement
and on the East by the Street situate lying and being in the Estate of
Ballybay in the County of Monaghan to hold on to said John McCleland his
heirs Execors Admons & Assigns for the lives of Samuel
McClelandthen
aged nine years of Margt McClellandthen
aged five years and of Hugh McClelandthen
aged two years children of said John McCleland with a Covenant for perpetual
renewal on payment of Five pounds thirteen shillings and nine pence on the
fall of each life and subject to the yearly Rent of five pounds thirteen
shillings and nine pence, and by the Deed of which this is a Memorial, the
said Patrick and John McCleland in consideration of said Marriage and the
portion of said Margt Oliver Granted unto said Joseph and William
Oliver and the survivor of them and his heirs All that and does the said
part of said townland of Nappagewhich
said Patrick McClelland was in matter of aforesaid [intelled?] unto,
together with all the other property whether real freehold or personnel
which said Patrick McCleland should during the intended coverture between
him and said Margt Oliver become seized possessed of interested
in or entitled unto And also all that and those the said Tenement in
Ballybay to which said John McCleland was entitled. Upon Trust among
other things to permit said Margt to receive an Annuity of Twenty
Pounds Stg yearly out of said Premises during her life in case she survived
the said Patrick McCleland her said intended husband with the usual powers
of distress and entry in case of nonpayment thereof at the times by the said
Deed for that purpose appointed which Deed is witnessed by Thos McClelandof

This
Deed is mentioned in HENRY WILLIAM OLIVER 1807-1888:His Descendants by Henry
Oliver Rea. James OLIVER Sr. was born in 1750 and had three sons: Stephen,
James & William (all mentioned in the deed). On 31 December 1790, James
OLIVER Sr. had leased this land from William IRVINE and apparently
transferred it to his son William OLIVER (b. abt 1780) who was farming at
"Six Mile Cross" - about six miles from Tattykeel, Co. Tyrone. At
the time, both Stephen OLIVER and his father James OLIVER were resident at
Corchoney.

of conveyance by James OLIVER of Corconny, Parish of Kildeep?, Co.
Tyrone of the one part and William OLIVER of Lisnae Corss, Co
[illegible] and of the said James OLIVER ... that William Junior? Esq. Due
by fiduciary? Legacy date the 31st day of Dec 1790 did demure and
sell unto the said James OLIVER all the holding occupied by the said
James OLIVER in Tullykeel in the Parish of Killduffs in the Parish of Tyrone
containing 13 acres 3.10 perches with the same more or less [?] two days
labour of a man yearly. To hold to the said James Olliver
his heirs {/, ?, } from the first day of November then last for the
acres of Stephen OLIVER, James OLIVER, and Wm OLIVER sons of the
of the aforesaid James Olliver party thereto at the yearly rent of
sixteen shillings per acre and one shilling per pound [?] fees. He the Said James
